An Aggrieved wife of has filed a Petition against her husband U/s 125 Cr.P.C.The Family Court has asked him to pay an Interim Maintenance of Rs. 15,000/- p.m. to his wife. The Appeal made against it has been failed and the troubled husband was made to pay her the said amount for almost 2yrs. The Aggrieved wife further claimed her right over Matrimonial House by two Separate petition and the Court restrain the troubled husband from creating third party interest in the said house. The Aggrieved wife further filed one more petition U/s 18 of Hindu Adoption & Maintenance Act for additional maintenance. The troubled Husband has filed Divorce Petition against the Aggrieved wife.
HE made the Hon. Court to club all the 05 petitions together. And started effectively leading the evidence in the Divorce Petition.
The Aggrieved wife moved 2 Recovery Applications in between and also moved 2 Applications for the Distress Warrants with malafied intention to delay the on going proceeding. HE contested effectively both the ER Applications as well as both the Distress warrants Applications. The Hon. Court has dismissed both the applications for Distress Warrants and has kept pending its decision on both the ER Applications till finalisation of all the Petitions.
The Aggrieved wife even made the Application before the Principle Judge for transferring the matter from the said Hon. Court to some other Family Court by making the allegations against the Hon. Judge. The same is rejected.
Finally the proceeding of Divorce Petition and all other clubbed Petitions is complete and the respective Hon. Family Court @ Bandra-Mumbai-M.S.-India has given its verdict by which-
The respective Hon. Family Court. has ---
- Decreed the Divorce Petition with Costs
- Dissolved the Marriage
- Restrained the wife permanently from entering in her so called claimed Matrimonial House
- Dismissed with Costs her all Petitions.
- Asked her to Vacate the flat Owned by the troubled husband, forcefully acquired by her and asked the husband to make small accommodation for her as per his choice.
- The claim of the wife for maintenance is dismissed and all the pending ER application treated as disposed off AND MOST IMPORTANT part is Asked the wife to REFUND TO THE HUSBAND THE AMOUNT so far she has received as per Interim Maintenance Order.
Thus HE achieved in giving the trouble Husband Complete relief, gave him backs his respect, reputation and the entire amount so far he has paid
